Enters into force: 12 November Environmental protection - Scotland
The Environmental Regulation (Enforcement Measures) (Scotland) Order 2015 provides the Scottish Environment Protection Agency (SEPA) with the power to:
- impose fixed monetary penalties (FMPs) and variable monetary penalties (VMPs), in relation to certain offences and,
- accept enforcement undertakings to better tackle environmental non-compliance, to better protect communities and to help create a level playing field for business.
An example of the types of offences in which FMP's and VMP's can be imposed include:
- unauthorised or harmful depositing, treatment or disposal etc. of waste and breaching conditions of a waste management licence and the duty of care under The Environmental Protection Act 1990
- offences relating to registration or authorisation of radioactive substances
- breaching the producer registration obligation
