The Water Act 2003 (Commencement No.11) Order 2012 and the Water Act 2003 (Commencement No.3) (Wales) Order 2012 bring into force measures in s.86 – which amends Part 2A of the Environmental Protection Act 1990 (EPA) in relation to contaminated land.

The definition of “contaminated land” in s.78A of the EPA is amended so that, in relation to the pollution of controlled waters, for land to be determined as “contaminated”, it must cause significant pollution of controlled waters or there must be a significant possibility of such pollution.
