The Town and Country Planning (Environmental Impact Assessment) Regulations 2011 were laid before parliament on 26 July 2011 and will replace the Town and Country Planning (EIA) (England & Wales) Regulations 1999 when they come into force on 24th August.
The Communities and Local Government Department plan to launch new guidance on the Regulations on or after the 24th August; at which point the advice in DETR Circular 02/99 will no longer relevant.
Planning related EIA in Wales will continue to follow the 1999 Regulations (as amended) until the Welsh Assembly Government has consulted on and amended their own EIA regime - consultation in Wales expected in late summer and new Welsh Regs anticipated by the end of the year.
