Synopsis:Article 5 requires the public sector to fulfil an exemplary role in the context of energy end use efficiency. As part of performing this exemplary role the public sector must communicate its energy saving actions to the wider public. The Directive requires the public sector to take up cost effective energy efficiency improvements that generate the largest savings in the shortest space of time. The consultation outlines the UK Governments preliminary views on implementing Article 5.

The Directive is intended to promote the cost effective improvement of energy end-use efficiency and to develop a market for energy services. The Directive has a broad scope, covering electricity and all fuel types (except aviation and marine bunker fuels). It applies to energy suppliers and final customers except those with emissions captured under the EU Emissions Trading Scheme (ETS). Article 5 is specific to the public sector and requires it to fulfil an exemplary role in the context of the Directive (see Annex A). The public sector is also required to put in place a number of measures to ensure that cost effective energy efficiency measures are taken up.

The UK Government and the devolved administrations have agreed to conduct a joint consultation on implementation of Article 5 of the Directive. It will fall to each administration to take decisions as to how to implement the Directive in relation to their own responsibilities.

Implementation of Article 5 involves assessing how far existing UK and devolved administration measures meet its requirements, and identifying suitable policies to fill any compliance gaps. This work is being carried out against the background of increasing national focus on energy efficiency and carbon abatement measures.

This consultation will outline the UK Government’s preliminary views on:

  • The scope and meaning of article 5;
  • The extent to which existing policies mean that the UK public sector may comply with article 5;
  • Preferred options put forward to fill identified gaps in compliance.

The consultation seeks respondents’ views on three main areas:

  • The definition of exemplary role and whether the public sector is fulfilling an exemplary role in the context of the Directive.
  • Whether a voluntary or legislative approach should be taken to the implementation of Article 5.
  • Which of the Annex VI options should be implemented?
