Synopsis:The Department for Business, Enterprise & Regulatory Reform (BERR) is seeking the views of producers of electrical and electronic equipment (as defined in Regulation 3 of the Regulations) and others on proposed amendments to the RoHS Regulations. The proposed changes are limited to two areas. These are the way in which the Regulations refer to those applications of hazardous substances that are exempt from the RoHS Directive, and the provisions dealing with the investigation and enforcement of compliance with producers’ obligations

This consultation seeks views on the proposed replacement of the Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment (RoHS) Regulations (SI 2006 / 1463) with a new set of RoHS Regulations. However, the main obligations of the 2006 regulations will remain. The new regs will be updated with greater enforcement provisions; and Schedule 2 that provides certain applications of the hazardous substances (whose use in the manufacture of EEE is otherwise prohibited) are permitted will be updated to reflect 3 recent Commission Decisions that have amended the list in the RoHS Directive.
